Terms of Use

1. What NearBuy is

NearBuy is a peer-to-peer classifieds platform that connects neighbors to buy, sell and swap second-hand items. NearBuy acts solely as a technology intermediary: it is not a party to any negotiation, does not own the listed items and does not guarantee that any deal will be completed.

2. Eligibility and account

• You must be 18 or older and legally capable of entering into contracts.
• You are responsible for the accuracy of the information you provide and for the security of your credentials.
• You may sign in with email and password, phone (OTP code) or a Google account.
• You are responsible for all activity carried out on your account.

3. Listings and content

You are solely responsible for the items you list, including photos, descriptions, prices, and the legality of owning and selling them.

• Listing illegal, counterfeit, stolen, dangerous or suspicious items, or items that infringe third-party rights, is prohibited.
• Offensive, discriminatory, misleading content or content that violates Brazilian law is prohibited.
• NearBuy may remove listings and suspend accounts that violate these rules.

4. Deals between users

Deals happen directly between users, including in-person meetings. We recommend meeting in public, busy places. NearBuy is not responsible for payments, deliveries, defects, damages or losses arising from negotiations.

5. Prohibited conduct

• Using the Service for fraud, spam, harassment or any unlawful activity.
• Attempting to bypass verification, access third-party accounts or exploit vulnerabilities.
• Automating access or collecting other users data without authorization.

6. Reviews and reputation

After a completed deal, both parties may leave a review. Reviews must reflect real experiences and may not contain insults or false information.

7. Intellectual property

NearBuy brand, logo, software and content are protected. You may not copy, modify or distribute them without authorization.

8. Suspension and termination

We may suspend or terminate accounts that violate these Terms or the law. You may close your account at any time via the "Delete account" option in the app.

9. Limitation of liability

The Service is provided "as is". To the maximum extent permitted by law, NearBuy is not liable for indirect damages, lost profits or losses arising from the use or inability to use the Service.

10. Changes

We may update these Terms. Material changes will be communicated in the app or by email. Continued use after an update means you accept it.

11. Governing law

These Terms are governed by the laws of Brazil. Any disputes will be resolved in the courts of the consumer user’s domicile, where consumer law applies.
